If I am to say my side in this little battle, I have to say teese is giving a way better battle, not that I'm hating on jester, but it seems teese has more experiance in this. And in my opinion, teese is correct
Art is meant to be an expression of the artist. All photo's I use in my photoshop work, I have gotten permission to use photos that aren't stock images or free to use. So when you claim stealing, perhaps you should ask first. I was going to go to college for computer graphics. I might just know the copyright laws.
I agree Tess. Please calm down Jester and reread the fine print attached to the forum rules. WIth that said, also take a look at the Rules of Conduct: So many people took photos from the Internet and pasted KaW images on them. Now, from a legal standpoint, it would be a liability if ATA were to use that artwork in advertising or other campaigns. It says very clearly that the artwork should be available for use by ATA's discretion (not yours or the owner of the sources). If you do not own the rights to the images that you Photoshopped then you do not have the right to share the image. If you used your own photos and ATA artwork then it would most certainly be acceptable. The next time you send in a computer generated image then please let it be known that the source images are free for ATA's use. I liked seeing the holiday artwork from the participants. I decided not to enter because of the rules. The limitation to free-to-use media made the competition more time intensive than I could put in for a simple hobby. When I participated in Kandi's KaWmunity-driven Winter art contest I still used images w/in fair use rules. source
No, I disagree Fiddler, you should openly mention that the entire work is free to share. Without actual clarification I will immediately assume that the source images are not yours.
The sources of my work are not all "free-to-share". Some I have had to email and ask permission to use their images. And as such their names have been printed into my work. If you knew where to look and looked hard enough you'll see their names.
jester, incorporating their names throughout the piece is not citing your sources. Did you really expect the devs to analyze your piece with a microscope and the come to the conclusion that the names they saw were sources that you received permission to use? Do you really think they have time for that? lol lets be realistic here. If you are going to use photos that you were granted permission to use then you need to make that known and cite your source. simple.
Kaw, just wanna make clear, this contest is spirit of holiday ..what does we mean of 'holiday' but some of them are actually not hitting the subject..
You're an idiot Tessa. Maybe if you looked for my submission you'd actually see its a photo of me and my fiance. A real. Life. Photo. Get your head out of your ass before you tell me my submission isn't "worthy".
OH and "was going to go to college" doesn't mean you did and does not prove that you to know the copyright laws....   as far as your submission, idc. My argument isn't even directed at your submission, it is directed to those that ignored copyright laws and to those that were just flat out homely. You are the one getting defensive and taking everything i say personally. I understand that you wish you had been selected as top 10, i truly do... but you need to stop looking at everything as a personal attack lol.
And i'm simply trying to show you and others who have posted similar blasphemy that the dev's were not being bias. Take the times to do things correctly or don't do them at all.
Thank you for the reply. It isn't ethically or legally appropriate if you're hiding their name. Also, it means that you don't have the right to let someone else use their image in ATA's realm. Remember, photographers own their photos and make their money from it. If you take professional photos to get copied at a print store you will be turned away if they find out. You need permission to use their work. I had to buy the rights (a couple dollars for a quick laugh; meh) to get the stock photography for personal use. When I posted the joke image, I still posted it with the information regarding the sources, it is the right thing to do. If you are studying Graphic Art then you should be well aware of how the market operates and the revenue streams from image rights. It would be prudent to start getting in the habit of paying respect for your sources. That is exactly the crux of the matter. If you alter images that aren't yours then you do not have the right to let ATA use your images. By all means, do what you want to the media, as long as you are not planing to sell your art or share the image. According to ATA's legal fineprint it seems that the artwork should be available for their use (if need be). I planned on making a wreath made from superimposed images of KaW items and then doing a quick color change of the splash screen girl. After an hour, I realized that the artwork was more grand on a conceptual level rather than the actual implementation. The artwork would be made entirely from ATA images and fit within the terms set by KCo. So yes,computer-assisted work could be done, but it would take a skilled artist to make something original. There were far better works sent in than my excuse of art.
Well i liked mine for what i was able to get done lol never had time to finish it gave up on it with work and rl in the way better luck next year for me haha good luck finalist great job everyone who took the time to at least enter
#4 I vote in protest, and against my own better judgement relating to my moral opinions upon a matter I will not discuss in public. Which has nothing to do with the fan art so I'm voting. Thank you. Happy New Year.
