I still have services I paid for on this account ie my pro pack items gold I purchased with nobs used to buy buildings and lands ... And if those very lands and or buildings I purchased with real cash were things taken (or allies for that matter) out side of normal game play ie devs deleting them off my account so I can no longer use them it constitutes fraud on their part denying me services I paid for
Not my issue they made those items and lands permanent parts of the game ie I can't sell them or use them as liquid assets so they belong as part of the service forever
"you acknowledge and agree that you shall have no ownership or other property interest in the account"
Read the fine print they also acknowledge if any part of their tou goes against federal state or local laws in the state of Cali or city of San Fran their tou is null
Also the bit of tou u are quoting has to do with ur right to sell / transfer ownership of ur account to another party not to do with weather u have rights to content of purchases u made in game
The contract u enter into with kaw is with the purchaser and ata via apple or goggle pay (or however u buy stuff) therefore u don't have a right to transfer to a 3rd party that part of tou is common law and practiced in most business
Does that matter? Ownership is still ownership. Our disagreement is about what buying xstals is, are you buying goods or are you buying a service?
This was in my mind when I was reading the comparison with restaurants  Then again, if one bought crystals or nobs just before being resetted (like one of our clan mates few months ago) or buildings torn off, etc, one could contact Apple or Google to get back the cash that was just spent. That was my advice to that clan mate who subsequently contacted Apple and got back her money. The key phase here is "just before".
Lol as long as the device was paid for and is still being provided under the contract of purchase u have protection till that sevice is terminated by u or that company goes out of business with in reason of course
Yup, like you mentioned, that is provided under contract of the purchase, or rather, the warranty for the product. In this case, under the contract of purchase, which is the ToU, nothing belongs to the buyer But it's a wonder why anyone would pay for things that don't belong to them
Say I buy a subscription to a newspaper ... I pay for three years service ... I have the right to that service for the three years ... Unless I cancel the service or the newspaper goes out of business Only catch to that is if I fail to abide to my end of the contract whereas I fail to pay or make delivery of said newspaper impossible to be finished or in some other way break terms of the contract In this case no terms of purchase contract was broken except buy ata there was no breach of ata tou (even the parts that wouldn't stand up in court) there was no malice on the part of any player using the "bad code" after it became common knowledge to ata and the rest of the kaw community because at that point no ata representative made any attempt for weeks to inform anyone it wAsnt intended code only after they decided to act weeks later did they make any acknowledgement that there was a problem with the in game mechanics that was not intended to be used by players Simply put ata screwed up by not simply making a statement saying that this function was not intended for use and anyone using it would be penalized until they made that clear, anyone using the in game features were in every way following the game as written by the developers and did nothing wrong Ata screwed up and took it out on players and let other players take the hit for their mistake They let both sides down on this and then overreacted in response to their failure to act on the subject
I see a contradiction in what is being said here by those taking side of exploiters. They say that others would have done it if they knew about it, and also they say that it was common knowledge to kaw community; yet only 155 accounts were caught doing it
Nice catch Nash. I had never heard of it until the post by kaw_admin a couple days ago (and know many others who had never heard f it either). It wasn't common knowledge.
And they are only saying 155 players abused it That's not counting players who did it one or two times or players they are not penalizing
No matter what you say, they are still protected by the ToU that everything in game belongs to them And you guys had to agree to the ToU before playing.
