The term "indemnity" is one to use when dealing with insurance. If you have 0 fault, you should not have to deal with anymore than the immediate consequences and the at fault party's insurance should take care of rental, and all damage reparations. "How's your health, as a result of the incident?" Should be the first thing they ask. Perhaps you should remind them of that.

    Again
    - I have witnesses that support that he was liable
    - The other driver admitted his fault to the police officer of course he can deny makin those statement
    - the officer told me that the way he hit me supports that he was liable. The only way in at fault is if it's possible to drive my car in such a way as to ram my front door into his front bumper
    - he got traffic ticket for failure to yield to oncoming traffic when making a left turn
    - the fool after hitting me...uncontrollably spun and hit another car.

His insurance company will be dealing with 2 claims

Omg the lack of insurance knowledge on here is about to drive me crazy. I guess I need to hold an insurance101 seminar.

They will play nice and tell you they will take care of the problem. It's all lies. Most ppl that get into this type of situation are just trying to get their basic interests addressed; like rental car; a few doctors bills

  12. Re: car accident insurance question UPDATED

I got hit recently by a Driving School Learner when she failed to stop leaving a fuel station. My insurance company dealt with everything. I never once spoke to the other insurance company as they don't represent me. Had a rental straight away. The personal injury side takes longer to conclude.

I guess my situation was different to yours Tiger as liability was clearly on the part of the Driving School. The instructor even said to me "I nearly stopped her!"  Yeah right! That's what dual control is for you fool ;)

In April some grandmother plowed into my Nissan. Since it was totaled, I had the damage claim go towards my new car, a Sporty Nissan. While I waited for my new car to arrive, I took taxis for a week and have to my insurance. My insurance provided me with a compact to drive soon after.

Take a note of everything in the car and claim damage from broken glass. If you got something broken like a iPad with cracked screen, claim it was broken in the car at the time.

Personally, dude, if your insurance company requires you to directly deal with the other company, your company sucks. Get a better policy.

  16. Re: car accident insurance question UPDATED

Find a lawyer and sue him.

  17. Re: car accident insurance question UPDATED

From what I'm told everything is smooth sailing if he admits liability

Problem is if he doesn't - insurance company will believe him even if there r witnesses and police statements supporting me

  18. Re: car accident insurance question UPDATED

Tiger you need to switch Insurance companies. They should deal with all of the work. They also should get you a rental. If police say he was at fault and his insurance denies pay. It should be your insurance companies duty to file a lawsuit against them. None of which should affect you.
