Unless you are using select rifles from WW1/WW2 days like the M1 Garand, then no you would not happily unload a few clips on them. Modern weapons use these magical devices called magazines, not clips. Every time someone says clip instead of magazines, Wayne LaPierre weeps! Point gun at cop = get shot. If you had a gun and someone pointed one at you, what would you do? This could be Mostly resolved if no one had guns
If the guy had any intention of shooting the police officer he would have shoothim already instead of waiting for the officer to pull his gun and shoot him
That's no justification at all, many soldiers drafted into the Vietnam war didn't shoot their guns at first armed combat, but did later on because their country willed them to, it was their duty. I know it's a bad analogy and doesn't fit the situation but my point is hesitation does not mean someone won't do something.
You are going by the plaintiff's word in a $250K lawsuit in his favor! You think his details of the account are exactly the way it went down or is there a chance he embellished just a bit to make his case? Nail clippers are generally silver and shiny, a longer pair could have been seen as a knife by someone else on the public system. Easy enough. Are the police supposed to ask first react second? Or should they treat it like there is a possibility of incident? If the officer just got him to the ground and handcuffed him immediately before continuing with the investigation then I don't see harm in that. It's better safe than sorry for a job that puts you face to face with some of the potential worst people in our country Just like anything these days, the sissy ass people who have anything done to them that they don't like, go crying about it and get loads of cash based on a flawed legal system. He doesn't deserve $250K over that. No one does.

Sorry bro totally forgotten that I had stated I was using a type of gun that used a magazine not a clip. Oh wait I just stated "a gun" my bad. I'm sure it's ok if my theoretical gun in the theoretical scenario is a ww1 gun with a clip. But alas we don't get many police shootings or shootings in general here due to stricter gun laws. We also have very few americans here too, that probably helps alot.
And in closing, I've always found that going about my daily grind, paying my bills on time and buying whatever I need(not want) seems to work ..... I haven't been shot by a police officer once. Maybe just maybe some people think the world owes them a certain standard of living. I say get a job - there's 8-10 hours a day your "idle hands" are busy making you a productive member of society. "Idle hands" are the devils play things.

Yes. I would expect 7 officers approaching 1 person to question, and be on guard, first versus reacting the way they did in his claim because his "weapon" wasn't visible. That lawsuit may sound ridiculous to most of you but we also don't know if that person sustained any injuries from what happened. We don't know if he had a previous injury that worsen due to that situation. "Looks like" isn't a good reason to be that aggressive with someone. A nail clipper can look like a knife if you're not paying attention. But it's still not a knife. They can be used as a weapon, but it wasn't in that case. There's been cases of cops shooting someone because it looked like they were holding a gun, when they were actually holding a wallet. If I remember to search and can find a link to that specific incident I'll post here.

@LMABAO The police have to look into the claim not the aftermath. All it takes is for some ass to say he was flashing a knife around (even if he wasn't) and they have to respond as if he has a weapon and the potential to use it. Sucks but that's the way our society has become. There's some sick individuals and the police put THEMSELVES on the line. Easy to sit back and be cynical when it's not our lives in jeopardy EVERY shift. If he truly sustained bodily harm that had any profound impact on his future or significant injury than sure maybe action is needed and possibly a suit. But to me it seems like another case of "the bad policeman beat me up" syndrome. I love my country, but sadly we have gone from stand up, driven, honorable, self accountable, understanding, and fair to sniveling, self centered, spoiled, arrogant, "everyone owes me something" babies.
