I haven't made a thread in a while, so I might be a little rusty. I found this to be interesting though and thought to share it all with you. Enjoy. So, recently Apple has been under a lot of scrutiny. The most recent event that people are getting outraged over is Apple's iMessage. Many former iPhone users are upset that after switching to an Android, they did not receive text messages after the switch. Apple has experienced issues with users not receiving text messages after switching from iMessage on an iPhone to an Android device. If an iMessage fails to go through, it is supposed to default back to a text message. Apperently, this has been going on since the release of IOS 5, and just now did Apple recently release a web tool to help users switch from IOS to Android. One person was fed up with this and decided to file a lawsuit against Apple back in May 2014. Just today did the judge Lucy Koh decided that Apple will have to face that lawsuit. The lawsuit is seeking class-action status. Apple wanted the case to be dismissed saying, "In court papers, Apple said it never claimed that its iMessage service and Messages application, which ran with iOS 5, would recognize when iPhone users switched to rival devices. “Apple takes customer satisfaction extremely seriously, but the law does not provide a remedy when, as here, technology simply does not function as plaintiff subjectively believes it should,” the Cupertino, California-based company said. Is Apple in the wrong? or Is the lawsuit justifiable?
Another thing that pisses me off is that, when you're texting another iphone user using iMessage, it uses up your data.. Kinda kills the point of having unlimited texting because you're already being charged for having it, and uses up your data as well.
My personal opinion, suing people is stupid. If you can't deal with a little hurt or inconvenience in life, then live in a box in a closet. By all means though, apple is a trashy company.
Personally don't see that Plaintiff has a case. Imessage works between apple devices, not surprising that the service does not extend over other non-apple consumer products. Just seems like another case of disgruntled consumer wanting too much from a simple piece of tech.
These users were not receiving text messages at all from their contacts who had iPhones. iMessage is supposed to be between two iPhone users, and when someone with an iPhone texts someone with an Android it supposed to go through just as a regular iMessage. So I do some valid reasons for a lawsuit.
iMessage is between iDevices. Messages to droids are a SMS Not seeing why they are complaining. A whole separate thing.
Here's a marvel idea, use the text message app. WHOA. It's like the idiots with the Toyota acceleration crap (completely false as proved by NASA and NHTSA btw) or with GM, put the vehicle in "neutral" push on the brake or turn the vehicle to the "ACC" position with respect to Toyota, and as for the GM issue, turn the key back on.
See reading these people seem to think iMessage automatically converts from iMessage to message. This is wrong. It's a setting. Which actually isn't enabled by default. Relating to another comment; iMessage doesn't use up my data when I use 3G, some reason it just isn't taken off my data allowance.
If you change ISP email addresses, and forget to tell your friends you changed addresses, do you then sue your previous ISP for not sending emails? No? Then case made.
Actually iMessage do use data. That's why a data connection is required in order to use it. Its just neglectable. One simple message use 1kb of data.
Well if the win, I'm suing kaw for being an addictive game that is not as fun as the hours I put int it suggest because lawers could get a court to reward a rock an entire lake because a river splashed it. /rant
This is someone looking for free money like all the others dumb ass lawsuits that have came out. This is the next big McDonald's coffee suit where someone did not know it was hot wtf is wrong with people anymore
